The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

The Site contains a range of information and tools about health and wellbeing. Our content is written by us or writers we’ve commissioned. The content we write and commission is usually written by health professionals including pharmacists, using academic resources and reference materials. Everything we offer on the Site is referred to in these Terms and Conditions.

All information contained on the Site, including information relating to medical and health conditions, nutrition, fitness, products and treatments, is for informational purposes only. It is often presented in summary or aggregate form. You should not rely on this information as a substitute for, nor do they replace, professional medical advice, diagnosis, or treatment, or any information contained on or in any product packaging or labels. 

The use of any information provided on this Site is solely at your own risk. Nothing stated or posted on this site or available through any Services is intended to be, and must not be taken to be, the practice of medical or counselling care. Developments in medical research may impact the health, nutritional, and product information that appears here. No assurance can be given that the information contained in this Site will always include the most recent findings or developments with respect to the particular material.

If you rely on any of the information provided by this Site, you do so solely at your own risk.

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

All our products are custom made to order and are only processed once you confirm and pay for your order. Please note some products may take between 2-5 business days to be made and be prepared for shipment, depending on the product. We will note the estimated processing time on each individual product page.

We reserve the right at any time to modify or discontinue a product or service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the product or Service.

For deliveries within Australia, all prices are inclusive of the Australian Government's Goods and Services Tax (GST), currently set at 10% of the price of all products, but subject to change. Prices displayed on this website are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice.

Prices of products placed in the 'cart' but not paid for are also subject to change and you agree to pay the price current at the time of payment. Prices listed on a quote we have provided to you remain current for 28 days from the date of issue, after which the quote will expire. You will need to request a new quote after this time, and the price and availability of items contained in the quote will be subject to change.

Any order placed by you in the manner described on this Site is an offer by you to purchase a particular product at the advertised price specified on this Site at the time you place your order, or if you requested a quote, for the price contained in the quote (including delivery costs and other charges). Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered. 

We may require additional verification or information before accepting any order. Verification required will be determined by us.

Artisan Chemist reserves the right to accept or reject your payment offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on the Site, or an error in your order, or we reasonably believe you have not complied with these Terms and Conditions or any other terms or policies linked herein, or we have previously refused to accept any order(s) from you. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. 

In the event that we make a change to, or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Account creation is not necessary to use the Site and is optional. When you create an account you are required to provide your name, email address, and a password. These are your credentials for accessing your account on the Site ("Credentials"). You may still check out without creating an account or setting a password.

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your order and refuse any and all current and future use of the Site or Services.

You are responsible for maintaining the confidentiality of your password and registration and are fully responsible for all activities that occur under your password and registration. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. You are responsible for all use of the Site and Services using your Credentials, including use by others to whom you have given your Credentials.

You may use the Site and Services for lawful, non-commercial purposes only. You may not use the Site in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of the Site and Services. You may not attempt to gain unauthorised access to any Services, user accounts, or computer systems or networks, through hacking, password mining or any other means. We may take any legal and technical remedies to prevent the violation of this provision and to enforce these Terms and Conditions.

We will endeavour to fulfil your order within the time specified in these terms, except: (a) where an incorrect or incomplete delivery address has been provided; (b) when incorrect payment details, including credit card details, are supplied; (c) where correct credit card details are supplied but funds are not approved; (d) where we believe the order to be fraudulent; or (e) where cleared funds through your nominated payment method have not been received.

In the event that you supply incorrect payment or delivery details, Artisan Chemist will take all reasonable steps to contact you using the personal details that you have provided. Artisan Chemist accepts no responsibility for address details entered incorrectly by the customer. We will attempt to deliver the product but we cannot guarantee delivery if you have entered address details incorrectly. 

If an order is returned to us by our delivery services due to reasons of error in entering address details, or your failure to accept the delivery, we will not be responsible for additional delivery charges to re-ship to the correct address. If your supplied contact details are incorrect, we will not be held responsible for not fulfilling your order, nor for being unable to advise you that this is the case.

We accept all major credit cards including Visa and MasterCard. There is no surcharge for Visa or Mastercard transactions.

Please be sure to provide your exact billing address and telephone number - the address and phone number your credit card bank has on file for you. Incorrect information may cause a delay in processing your order.

Your credit card will be billed as soon as (i) your order is placed in the case of products ordered directly from our website, (ii) upon completing online checkout in the case of products where you have received a quote from us, or (iii) upon your telephone or in-person payment of a quote or order via our physical store. This is done to protect the security of your credit card details, as we do not store your card details at any point.

In the event that we cannot fulfil your order or some items cannot be shipped, we will refund the difference back to your credit card. These refunds may take several business days to appear on your statement.

For your convenience we offer third party payment options including Afterpay. By choosing to use one of these payment systems, you are agreeing to payment terms between you, the customer, and the payment system you select. For full terms and conditions, please refer to their website:

Gift cards may be redeemed online only. Purchases are deducted from the gift card balance up to its balance. Any unused balance will be available for a later purchase. If an order exceeds the amount of the gift card, the balance must be paid with a credit card or other form of payment. Gift cards cannot be used to purchase other gift cards. Gift cards cannot be reloaded, resold, transferred for value, or applied to any other account, except to the extent required by law.

It may take up to 1 hour for your gift card to be activated. You will receive an email when the activation is complete, please be sure to check your spam folder. If you require further assistance, please contact us.

Gift cards are to be treated as cash. Defaced, mutilated, altered, lost, or stolen cards will not be replaced, refunded or redeemed. We are also not responsible for cards that are used without authorization, so please safeguard your gift card and keep the redemption code secret.

You are liable for all transactions on your card except to the extent to which there has been fraud or negligence by us or any of our employees. Artisan Chemist is not responsible and will not redeem the balance on gift cards purchased from any unauthorised third party, such as eBay or Craigslist. We have the right to request alternative forms of payment if a fraudulently obtained gift card is used to make purchases on the Site.

Gift Card balance must be redeemed before the expiry date shown on the card. Gift card balance has an expiry of 36 months (3 years). It is the responsibility of the gift card recipient to use the full value of a gift card before the expiry date. Unused balance upon expiry of a gift card will not be refunded or credited. 

Artisan Chemist gift cards sold on our Site are issued by Shopify Inc on behalf of Artisan Chemist. Gift cards and the purchase, use or acceptance on the Site are subject to Shopify’s Gift Card Service Terms (available at: www.shopify.com/legal/terms-gift-cards) in addition to the Terms described here, and our Privacy Policy. Artisan Chemist may provide gift card purchasers with information about the redemption status of gift cards in its sole discretion.

Each purchase will be shipped as a separate order and cannot be combined. We use express delivery services that usually take 1-3 days to ship. Once your order has been despatched, you will receive an email or sms containing your tracking number and a link to a page where you can track the status of your shipment. Artisan Chemist cannot guarantee delivery times, including due to reasons beyond our control. All deliveries are made Monday - Friday via StarTrack. There are no weekend deliveries.

For all purchases in Australia a flat delivery fee of AU$10.00 currently applies for express delivery to street addresses, or AU$20.00 to P.O. Box addresses.

Parcels will require a signature on receipt. It is recommended to provide a work address for delivery if no one is home during business hours. Where no one is home to sign for the parcel, a card will be left detailing where the parcel can be collected during normal business hours. At this time we are unable to offer an “Authority to Leave (ATL)” option at checkout.

We do not accept returns or exchanges for reasons of dislike, change of mind, order of incorrect product, the product not suiting your needs, the product being no longer required, or if you over-order. Despite the above, nothing in these Terms and Conditions alter any rights you may have under the Australian Consumer Law. 

Contact us if you have any issues or problems with your order (such as damage during shipment, or receiving the wrong product) within 7 days of receipt of your order. Please ensure you retain proof of purchase from our Site, and the goods in question. To request a return or a refund, please email info@artisanchemist.com.au with your name, order number, contact details, and a detailed description of the problem, with photographs attached if possible. We will evaluate your request as soon as practicable, and respond with instructions for return if applicable, and organise replacement if required.

Artisan Chemist reserves the right to assess the condition and age of returned goods prior to providing an exchange or refund. This may result in an exchange or refund being refused.

Any personal information collected by us through your use of this website will be dealt with in accordance with our Privacy Policy.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

Certain content, products and services available via our Site may include materials from third-parties.

These links are provided for your convenience only and do not mean that we endorse these sites or the products and services they provide. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. 

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Occasionally there may be information on our Site that contains typographical or photographic errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Any unauthorised use of the materials appearing on this Site may violate copyright, trademark and other applicable laws.

We give you permission to use the Content for personal, non-commercial purposes only. You may also print, download, and store articles and other information for your own convenience, but you may not distribute, republish (except as permitted in this paragraph), sell, mine, exploit, frame or scrape any of the Content, or exploit the Content for commercial gain without the prior written consent of Artisan Chemist.

Upon a request by us, you agree to defend, indemnify, and hold harmless Artisan Chemist and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of the Site and the Services. We reserve the right to assume control of the defence of any third party claim that is subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

This contract and any supplemental terms, policies, rules and guidelines posted on the Site constitute the entire agreement between you and us and supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).

Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

You agree that the law of the State of Queensland, Australia governs these Terms and Conditions and any claim or dispute that you may have against us. You further agree that any disputes or claims that you may have against us will be resolved by a court located in Queensland.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website.
